   अनुच्छेद 5 में प्रावधान किया गया है कि यदि कोई व्यक्ति , संविधान के प्रारंभ 1 पुनर्वास अनुज्ञा ( षेसेट्ट्लेमेन्ट् फेर्मिट् ) पर भारत के राज्य क्षेत्र में अधिवास करता है , उसका या उसके माता-पिता में से किसी एक का भारत में जन्म हुआ था वह या संविधान के प्रारंभ से ठीक पहले कम से कम पांच वर्ष तक भारत के राज्य क्षेत्र में सामान्यतया निवासी रहा है , तो वह भारत की नागरिकता का हकदार बन जाता है .
