   यदि किसी मामले में विधि पहली बार तय हुई है , यदि वाद इसलिए उत्पन्न हुआ था कि विधि स्पष्ट नहीं थी , यदि अपीलकर्ता अपने वाद के अंश पर बल नहीं देता , यदि मामले में विधि के महत्वपूर्ण प्रश्न अंतर्वलित हैं जिन पर निर्णय होना है , यदि वाद परीक्षण-वाद ( टेस्ट केस ) हो और प्रत्यर्थी को संघर्ष का आघात सहना पड़ा है , यदि प्रश्न किसी हाल की विधि की व्यवस्था से संबंधित है या यदि न्यायालय ने किसी भ्रांतिपूर्ण न्यायिक स्थिति का स्पष्टीकरण किया है तो वहां न्यायालय दोनों पक्षों को अपने अपने खर्चों को वहन करने का आदेश दे सकता है .
